1. Describe the institutional features and powers of the Congress of the United States. Be sure to consider terms and modes of election as well (see Article I of the Constitution). Consider bicameralism as well: what are the features of bicameralism, and does it accomplish what it is meant to accomplish? In light of what you have read, and current events, do you think Congress as an institution is functional or dysfunctional?
2. Describe the institutional features of the President of the United States (POTUS) as put forth in the Constitution. Be sure to discuss the nature and purpose of presidential terms, qualifications, and powers. Discuss the nature and impact of the 22nd and 25th Amendments. What kind of character does the executive need to have and why? How do the institutional features of the Executive contribute to the executive having a certain type of character? (US Constitution, article II, section 1, clause 1, 5-7, section 2, clause 1-3; you may also want to find Federalist No. 70 online).
3. Alexander Hamilton wrote that the laws are a “dead letter without courts to expound and define their true meaning and operations” (writing as Publius in Federalist No. 22). Why is this the case? How does the institution of the Supreme Court of the United States (SCOTUS) perform a function essential to government? How does it relate to the other branches? Elsewhere in The Federalist, Hamilton writes that, from “the nature of its functions,” the judiciary “will always be the least dangerous to the political rights of the Constitution… It may truly be said to have neither force nor will, but merely judgment” (Federalist No. 78). Is Hamilton’s view correct in your view, today?
