Since the mid-1990s, forty-seven states have established a patient bill of rights that attempt to protect against managed care abuses. One of the primary obstacles to federal enactment has been uncertainty over the consequences of increasing MCOs’ liability exposure (Mariner, 2016).  State’s statutes on managed care liability are not consistent or clear about which forms of direct or vicarious liability are included. The statutes give an individual the right to sue MCOs for wrongful actions that cause personal injury, however these statutes target narrower or broader ranges of managed care activities. Most statutes are not clear about which forms of direct or vicarious liability they might include.  Direct liability is when the MCO is the primary wrongdoer and vicarious liability holds MCOs secondary liable for errors made mostly by treating physicians.  Managed care liability statutes also vary in the preconditions for bringing suit. California, Georgia, New Jersey and Washington limit suit to patients with serious injuries and California, Georgia, New Jersey and Texas require that external review channels be pursued prior to suing for damages (Mariner, 2016).

The Employee Retirement Income Security Act (ERISA) shields managed care organizations from liability when they are part of an employee group health plan governed by ERISA. Unlike patients with other types of insurance, patients in ERISA health plans do not have a malpractice remedy for a managed care organization’s negligence. ERISA prohibits negligence claims against ERISA health plans for injuries resulting from denial of plan benefits, failure to use qualified physicians, utilization review, or improper plan administration. Attorneys are unwilling to file suits based on coverage denials because leading ERISA preemption rulings have not yet been overruled (Hall & Agrawal, 2003).

When denied coverage for medically necessary care, MCO or PPO plan members must go through levels of appeals, which are reviewed by their insurance company. After the appeal process, the member can take his case to an independent review board and/or litigation.  The review board is a group of medical professionals who are not affiliated with insurance companies, nor do they have any fiscal bias as to whether or not claims are paid or denied. Generally, this is where medical necessity denials appeals are given the full, fair, and objective review that families and patients deserve; and conversely, where we see the most denials overturned (2019).

Managed care organizations where created to intend to reduce unnecessary healthcare cost through the use of patients being able to select care in terms of affordable costs and physician economic incentives (Showalter, 2017). Managed care organizations have a main focus for more preventative and primary care. Within managed care organizations lie health maintenance organizations and preferred provider organizations to provide the best care at minimal costs. 

Due to managed care organizations placing requirements on physicians to take on more responsibilities with less patient referrals to specialists, an increase of suit are linked to the growth in managed care. With managed care organization personnel making decisions, physicians are often caught in the middle toward their responsibility to the patient and to the obligation to the managed care organization about insurance coverage for hospital stays. However, working under managed care organization personnel doesn’t not necessarily make them non-liable. 

There is an Employee Retirement Income Security Act that protects managed care organizations from liability when they are part of an employee group health plan affiliated with the Employee Retirement Income Security Act. The Employee Retirement Income Security Act does not allow negligent claims to be made against the Employee Retirement Income Security Act health plans for injuries (Hall & Agrawal, 2003).

Upon arrival to the United States, these immigrants were accepted as citizens of the United States of America, but were not seen as citizens by the people who already resided here. Industrial jobs were booming at the time, but workers were underpaid compared to the labor performed during these jobs. Since these minorities were seen as outsiders during this time, I feel that it was very difficult to live the same type of lifestyle lived by those who were born and raised. Many of your experiences can be analyzed using sociological concepts. For your final assessment, Assessment 6, you will complete a Sociology of Me and apply many of the concepts you have learned about in this course to your own life. For Assessment 5, begin to think about which concepts you would like to apply to your own experience, develop an outline, and identify appropriate resources. In order to complete this assessment, you will need to show your understanding of some additional concepts related to social structure, education, and technology/media.
We have learned how a society’s culture can influence people. There are other elements in society, however, that also affect our decisions and behavior. Sociological research has found that in addition to culture, social structure and groups also significantly impact many of our individual choices. Our position in the social structure affects our behaviors, attitudes, and ideas. For example, an important element of social structure are groups. We belong to a variety of different groups. Decades of research have documented the impact of group conformity on the individual. Although people tend to often believe that they act as individuals and aren’t impacted by others, research has found this is usually not the case. The Milgram experiment in your Resources is a great example. Milgram (1963) examined conformity and obedience and found that people are highly influenced by authority and the demands of conformity, even to the point that we will inflict pain on another person to obey authority.
Sociologists also study education and how it is impacted by a society’s culture and structure. The purpose of education is to provide knowledge (facts, skills, cultural norms) to members of a society. In the United States, education teaches us not just skills, but also how to be effective citizens. Education transmits the dominant culture, ensuring that children understand cultural norms and values. Educational attainment impacts life outcomes—it affects our occupation, earnings, work conditions, and health. Thus, education is related to social inequality. We have a tendency to assume that education is an equalizer in the United States, but this is something that is debated by sociologists. Is education equally available to everyone? Studies suggest it is not. Social class can impact the quality of school children attend, what they study, and how many years they attend school. Many students graduate from college with significant student loan debt. How might someone’s experience after college graduation be different if they graduated from college debt-free because their parents could afford to pay for it?
We regularly see new products and services as a result of increasing technology. We often take the influence of technology and media for granted, but it has a substantial impact on how we understand our culture and society as a whole. Many new products and services are a response to society’s changing needs. But technology can also serve to shape the values held by a society. Think about how our interaction has changed in the past ten years as a result of technology. Has that impacted our values? A small number of corporations deliver Internet platforms and a small number of corporations produce most of our media. What impact does that have on our access to technology and information?
