In contract law consideration is a thing of value which is given by both parties involved in a contract. This value should be determinable on an objective basis. Consideration induces the parties involved in a contract to enter into the agreement.
Quasi contract is a contract that exists due to a court decree or order of court and not on the basis of agreement of the parties involved in the contract.
Requirement of consideration is met in a quasi contract through the doctrine of quantum meruit. For example if a quasi contract comes into existence due to a claim for unjust enrichment i.e. the defendant was enriched and this enrichment came at the plaintiff’s expense then the consideration for the defendant will be that the defendant will have to make restitution. Consideration for plaintiff is the service or the product supplied by the plaintiff to the defendant.
Thus in a quasi contract the requirement for consideration is met by the decree of court under the doctrine of quantum meruit.
