If I was the supervisor then I will not put Kroll directly into counselling by a psychologist where Kroll have any objection. In such situation medical examination prescribed by ADA does not stand effective. Here what Kroll wanted was a proper guidance and counselling so that he can come out of depression.In such situation I will first talk to the individual employee and try to know the present state of mind and why that person is looking depressed. I will make an ambient atmposhere where employee can share with me the reason for such mental instability whether it is personal reason or job related.If I can counsel that affected employee then I will do so, if not then I will tell the employee that for better mental development and coming out from depression, he should attend counselling.It will not be concerned with medical examination as stated in the case.
