Federal employment regulations constrain the hiring process using the different laws, act and commission. These regulations are implemented as follows:
A. An employer cannot put any advertisement regarding the employment that discourages people on the basis of race, religion, sex and ethnicity among the others. It is strictly unlawful.
B. An employer cannot ask candidates the questions that create the scope of discrimination of any kind. The question regarding the age as how old are you and nationality such as are you a US citizen, cannot be asked. So, there is a constraint upon the hiring process.
C. An employer has to ask only those questions that are objectively associated with the job and judge the candidate on the basis of competencies rather the charateristics of the candidate.
D. An employer cannot discriminate of any kind among the candidates at any state of the hiring process.
There are different laws such as civil rights act of 1964, Americans with Disability act as well as the Equal Employment Opportunity Commission that proactively monitor any cases of discrimination and restrict the employer to act properly in hiring process.
